Off-hire clause – route to vessel’s drydocking port coinciding with route to loadport under charterers’ new fixture – vessel on-hire en route to drydocking port
The Facts
The parties agreed that the vessel would drydock in Greece after discharging cargo at Ravenna. After discharge, the vessel proceeded to Piraeus where it was drydocked.
The day before the completion of drydocking, owners informed charterers that the vessel would be at their disposal the following day. On the same day charterers voyage chartered the vessel to load cargo at Novorossiysk, Black Sea.
It was agreed that Piraeus was, with a slight deviation, en route from Ravenna to Novorossiysk.
Charterers contended that time lost by drydocking was for the duration of the voyage from Ravenna to Piraeus. Owners contended that time taken sailing to Piraeus was not lost because that voyage was en route to Novorossiysk.
